The case

The strongest honest argument for each side, then the ruling.

The Garcia argument

The Grateful Dead never recorded this in a studio. The only studio take is on Garcia's solo album, where he played everything but the drums. As a band piece it lived entirely in performance: electric from 1971 to 1973, acoustic on its return in 1980 at 7:34, and by 1993 a 14-minute piece in which the band breaks apart into an open jam before finding the last chorus. The melody is a doorway to that middle.

The Lennon argument

There is a finished song here, with a written melody and a lyric Hunter shaped as an elegy. The 4:26 solo recording is complete and tidy. The verses and refrain are sung the same way each time, and the improvisation always comes home to them.

The verdict: GLI 24

A small written song used as a launch point, and after 1980 the launch is most of the flight. It sits right of Playing in the Band because its open section stays closer to the tune, and left of Eyes of the World because less of a typical performance is song.

Evidence dimensions

Each runs from 0, Garcia, to 100, Lennon. Their weighted composite is 24. The published GLI is 24, the same.

Structural FixityHow much of sequence, form and duration is settled beforehand?
28
ElasticFixed

A short verse and refrain around a middle with no set length.

Performance ConsistencyHow far can two performances differ and still be the same work?
18
TransformativeReproducible

An acoustic 7:34 in 1980 and an electric 14 minutes in 1993 are both the work.

PredeterminationHow much of what matters exists before the performance begins?
26
EmergentPredetermined

The tune and lyric are brief. Most of a late performance is invented on stage.

Development MethodHow does the music move forward?
18
ExploratoryComposed

The band splits apart into open playing and regroups for a last chorus.

Recording SpecificityDoes the recording document an occurrence, or define the object?
32
Documents eventDefines work

The only studio version is Garcia overdubbing himself. The Dead never recorded one.

Transformational tolerance

Very high. It was shelved for seven years and came back first acoustic, then electric, and stretched further each decade.
